All content on SCANTUARY, including the name, logo, original theories, conceptual frameworks, unique research, and performance art documentation, is the exclusive property of the site owner, Jacob Miguel Samano (operating professionally as Jacob Miguel), unless otherwise stated. If referencing our conceptual frameworks or research, citations must include the brand name (SCANTUARY), the creator's name (Jacob Miguel), and a direct link to the source material.

INTEGRATION OF DIGITAL, PHYSICAL, AND CONCEPTUAL DOMAINS:

The provisions, protections, and restrictions detailed throughout these Terms explicitly extend across the entire ecosystem of the creator's brand and operational domains, including:

 * **SCANTUARY.ART:** The official digital archive, domain, web repository, and public-facing portal for all digital media, performance documentation, and research notes.

 * **SCANTUARY.STUDIOS:** The private physical workspace, studio production house, and material incubator where physical sculptures, installation blueprints, and performance rituals are conceived and constructed. This proprietary designation applies to all work generated within the studio's current private workspace footprint, as well as any future physical locations.

 * **SCANTUARY.FREE:** The foundational creative philosophy, independent movement, and sovereign framework utilized by the creator to establish, maintain, and legally enforce absolute, uncompromised human ownership over their own work, methodology, and intellectual 

NO RE-PACKAGING OR CONCEPTUAL PLAGIARISM:

The raw concepts, working notes, research methodologies, and philosophical frameworks presented here are the unique intellectual output of SCANTUARY. You are strictly prohibited from copying, paraphrasing, or lightly modifying these notes to claim them as your own original concepts, business models, or creative frameworks. Presenting adapted variations of SCANTUARY’s conceptual notes as your own independent work constitutes passing off and intellectual property 

MEDIA RIGHTS:

Ownership includes all original photography, scanned media, digital artwork, performance notes, and scripts displayed on this site.

PROPRIETARY FORMATS:

Protection extends beyond static text to include unique performance formats, interactive protocols, audience instruction sets, and structured experiential designs originated by SCANTUARY. While individual ideas are free, the specific execution, sequence, and structural staging of these performances are proprietary.

PROHIBITION OF SPATIAL SCANNING AND DIGITAL CLONING:

Visitors, audience members, and third parties are strictly prohibited from utilizing LiDAR, photogrammetry, 3D scanning software, or spatial computing devices to capture, replicate, or reverse-engineer the physical dimensions, geometry, or spatial layouts of SCANTUARY installations and sculptures. Digital replication of physical works for the purpose of creating digital twins, 3D assets, virtual reality environments, or augmented reality overlays without express written consent constitutes a material violation of these terms.

ARTISTIC METHODS AND RITUALS:

Protection includes the specific, proprietary methods, technical processes, and performance rituals utilized in the creation, preparation, and "waking" or activation of physical sculptures and installations. Unauthorized duplication, video tutorials replicating these exact foundational methods, or public staging of these specific creation rituals for commercial or instructional use without explicit written consent is strictly prohibited.

PROPRIETARY PROCESS AND INSTRUCTIONAL EXCLUSIVITY:

Any working notes, studio logs, or behind-the-scenes methodologies shared on this site are for archival transparency only. They may not be used as blueprints, instructional materials, or foundational data to establish your own commercial ventures, workshops, curated experiences, or artistic platforms. You may not claim authorship over the specific "problem-solving" methods or artistic solutions outlined in our notes.

USE OF SITE:

You may view and print pages for personal use, but you may not use our brand name "Scantuary" or replicate our performance methods for commercial purposes without explicit written permission. Unauthorized use of automated systems, "web-scraping," or software to extract data for the purpose of training generative AI models is strictly prohibited.

AUTOMATED EXTRACTION PENALTY:

Unauthorized scraping, data-mining, or extraction of content from SCANTUARY for the purpose of training machine learning or generative AI models constitutes a material breach of these terms. Due to the difficulty of calculating exact damages for the dilution of artistic style and identity, the site owner reserves the right to seek liquidated damages up to $5,000 per individual violation or unauthorized data access event.

RE-PERFORMANCE RESTRICTIONS:

The display of scripts, event scores, performance notes, or video documentation on this site is strictly for archival and educational viewing. Permission to view this material does not constitute a license to publicly re-perform, restage, or adapt these works in a public, commercial, or institutional setting without prior written consent.

DOCUMENTATION AND DERIVATIVE WORKS:

DIGITAL OPT-OUT REGISTRY:

In accordance with global digital data laws (including Article 4(3) of the EU CDSM Directive and equivalent domestic protections), the site owner hereby explicitly reserves all text and data mining rights for all content hosted on SCANTUARY. This site deploys machine-readable opt-out signals, including NoAI metadata headers, custom robots.txt crawler blocks, and a /.well-known/tdmrep.json protocol. Any automated bypass, deletion, or disregard of these technical mechanisms by AI operators, scrapers, or tech platforms constitutes a deliberate, bad-faith circumvention of proprietary protections.

FALSE CLAIMS OF AUTHORSHIP AND LIQUIDATED DAMAGES FOR CONCEPTUAL PLAGIARISM:

The public availability of SCANTUARY’s work notes does not grant a license of implied consent for any third party to claim prior or simultaneous discovery of these specific conceptual frameworks. Any unauthorized commercial deal, pitch, public project, or restaging that heavily replicates, mirrors, or clones the core concepts or structural staging detailed in our public notes without written, legally verifiable proof of independent creation prior to SCANTUARY’s first public disclosure will be pursued as a bad-faith violation of our copyright and proprietary identity.

In the event of such a violation, the offending party agrees to be liable for statutory damages, legal fees, and a baseline liquidated damages fee (representing a reasonable pre-estimate of lost licensing values and brand dilution) equal to the total gross revenue generated by the infringing project, or a minimum of $10,000 per infraction, whichever is greater.
